I filed a claim with her insurance and not mine cuz everyone told me not to. The claim adjuster on her insurance took her sweet time on finding her at fault which was an obvious no brainer since I had a witness. My car was towed at the scene, i gave authorization to the body shop but they couldnt fix the car until they got the check from AAA (her insurance). Now they wont cover the car rental from Feb. 25 to March 9th because they say i could of had my insurance fix the car and therefore it wouldnt have taken so long.... Technically, i dont have to file a claim with my insurance if im not at fault so why wont they pay?

AAA is right. You had a duty to mitigate your damages north carolina vacation rentals here. You could have filed with your insurance company north carolina vacation rentals right after the accident, had them fix the car and recover the damages from AAA. You wouldn't have had to pay for the car repairs, and you wouldn't have had need for the rental car for as long as you did.
TECHNICALLY, this is why you should have filed a claim with your insurance anyway. Even if you weren't at fault, they could have coordinate efforts to get your car fixed faster and saved you from having to pay for the extra time that you had the rental car.

First of all, you should have reported north carolina vacation rentals the accident to your insurance company. Insurance companies have a process call 'subrogation' which in effect is the insured party's insurance company paying the claim and then collecting from the insurer for the party at fault. This way each insurance company's lawyers deal with the other's lawyers and you have nothing to do with it.
